These Terms of Service ("Terms") govern your purchase and use of services from Cobb Financial Analytics ("we," "us," or "our"). By purchasing a service, submitting an intake form, or otherwise engaging with us, you agree to these Terms.
1. Description of Services
Cobb Financial Analytics provides fixed-price financial analysis, valuation, forecasting, business planning, and related advisory services for businesses, founders, and organizations. Each package has a defined scope, described on our website at the time of purchase.
2. Not Investment, Legal, or Tax Advice; Licensing Disclosure
Our services are limited to financial analysis, modeling, and forecasting to support your own business decisions. We do not provide personalized investment advice, securities recommendations, tax preparation, audit services, or legal advice. Deliverables should not be relied upon as a substitute for advice from a licensed attorney, accountant, or financial advisor where such advice is warranted.
Cobb Financial Analytics is not a Registered Investment Adviser (RIA), broker-dealer, Certified Public Accountant (CPA), or licensed attorney, and is not registered with the SEC, FINRA, or any state securities regulator. Any analysis referencing publicly traded companies or securities reflects independent research and modeling exercises for illustrative and educational purposes — not personalized investment advice, and not a recommendation to buy, sell, or hold any security. You should consult a licensed investment adviser, CPA, or attorney before making investment, tax, or legal decisions.
3. Intake Information & Client Responsibilities
To complete your order, you are required to submit accurate and complete information and documentation through our intake process before work begins. You are responsible for the accuracy of the financial information, documents, and details you provide. Our analysis and deliverables are only as accurate as the information supplied to us, and we are not liable for outcomes resulting from incomplete or inaccurate client-provided information.
4. Payment
Full payment is due at the time of purchase through our secure payment processor, Stripe. Work begins only after payment is received and required intake information is submitted. Pricing for each package is listed on our website and is subject to change for future purchases, but the price you paid at checkout is the price honored for your order.
5. Refund Policy
Because our services involve custom analysis work that begins promptly after intake, purchases are generally non-refundable once work has commenced. If you have not yet submitted intake information or work has not yet begun, you may request a cancellation and refund by contacting us. Refund requests are evaluated on a case-by-case basis at our discretion.
6. Delivery
Deliverables will be sent to the email provided at intake once completed. Delivery timelines vary by package and scope. We are not responsible for delays caused by incomplete, delayed, or inaccurate information provided by the client.
7. Intellectual Property & Use of Deliverables
Upon full payment, you receive the right to use the deliverables provided for your own internal business purposes. Cobb Financial Analytics retains ownership of its underlying methodologies, templates, and analytical frameworks, and reserves the right to reuse general (non-confidential) methods and templates in future client work. Deliverables are prepared specifically for the client and are not intended for redistribution, resale, or use by third parties without our written consent.
8. Confidentiality
We treat client financial information and business details as confidential and use them solely to complete your order. See our Privacy Policy for details on how information is collected, stored, and retained.
9. Limitation of Liability
To the fullest extent permitted by law, Cobb Financial Analytics' total liability for any claim arising from our services is limited to the amount paid for the specific service giving rise to the claim. We are not liable for indirect, incidental, or consequential damages, including business decisions made in reliance on our analysis. All analysis involves estimates, assumptions, and projections that are inherently uncertain and not guaranteed to reflect actual future outcomes.
10. Changes to Scope
If your business or project is more complex than a listed package anticipates, we will follow up after purchase to confirm final scope and any additional pricing before proceeding with that additional work.
11. Changes to These Terms
We may update these Terms from time to time. Continued use of our services after changes are posted constitutes acceptance of the updated Terms.
12. Governing Law
These Terms are governed by the laws of the State of Michigan, without regard to conflict of law principles.
